1. Services Offered
Evergreen Garden Ltd provides domestic and commercial gardening, landscaping, lawn maintenance, hedge trimming, planting, and seasonal clean-up services (“the Services”). By booking our services, you accept these Terms and Conditions in full.
2. Booking & Payment Terms
- Booking Confirmation: Jobs must be confirmed in writing via email, message, or signed agreement.
- Pricing: Prices are agreed upon in advance. Any variations (due to size, complexity, or additional tasks) will be communicated before work begins.
- Payment Methods: Accepted via bank transfer, card, or cash (if pre-agreed). Full payment is due immediately after job completion unless otherwise agreed in writing.
- Late Payments: Charged at 4% interest per day above the Bank of England base rate after 7 days of non-payment.
3. Cancellations & Delays
- Cancellations made with less than 24 hours’ notice may incur a fee up to 50% of the quoted service charge.
- We may reschedule work due to adverse weather, machinery issues, staff illness, or operational reasons. Notice will be given when possible.
4. Client Responsibilities
- Provide clear access to the work area.
- Ensure pets and children are kept safe and away from the workspace.
- Disclose any hazards such as buried pipes, wires, or fragile structures.
5. Limitation of Liability
Evergreen Garden Ltd is not liable for:
- Damage caused by undisclosed hazards (pipes, hidden objects, etc.).
- Pre-existing damage or poor structural condition.
- Any indirect loss, including loss of income or emotional distress.
- Delays or failure in performance caused by events beyond our control (see Force Majeure).
We carry full public liability insurance to cover accidental damage caused directly by our negligence during service delivery.
6. Force Majeure
We are not responsible for any failure to perform services due to reasons outside our control, including weather events, acts of God, illness, supply shortages, legal restrictions, or accidents.
7. Dispute Resolution
We aim to resolve any concerns fairly and quickly. If unresolved, disputes will be handled under the jurisdiction of the courts of England and Wales.
